Following the incident, Burkes fled across state lines but was apprehended the following day, February 3, in Hammond, Indiana. Officers from the Hammond Police Department executed the arrest in coordination with the Kankakee County Sheriff’s Office. Burkes has remained in law enforcement custody since that date.

Initially facing state first-degree murder charges brought by the Kankakee County State’s Attorney’s Office, Burkes will now be tried in federal court. Assistant U.S. Attorney Bryan D. Freres will represent the United States in the prosecution. Officials noted that an indictment is not evidence of guilt, and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt in a court of law.
